Drunk Driving Accidents In North Carolina
There were more than 11,700 alcohol-related car crashes in North Carolina in 2011, according to the University of North Carolina’s Highway Safety Research Center (HSRC). There were 5,863 alcohol-related accidents resulting in personal injury and 366 drinking-related fatal car crashes in the state in 2011.
In Buncombe County alone, alcohol was a factor in eight fatal car accidents and 162 car crashes with nonfatal personal injuries in 2011, according to the HSRC. Overall, there were 22 fatal car accidents in Buncombe County in 2011, which means alcohol was a contributing factor in more than 36 percent of car crash deaths in the Asheville area in 2011.
Drinking and driving is irresponsible and negligent behavior. Yet it continues despite stiff legal penalties for driving while impaired (DWI) in North Carolina.
A driver is legally intoxicated in North Carolina if his or her blood-alcohol concentration (BAC) is 0.08 percent or greater. A drunk driver may face criminal prosecution after a DWI accident and, upon conviction, be fined, lose driving privileges, and be sentenced to probation, community service, and attendance at Alcohol Drug Education Training School (ADETS). Multiple DWI convictions or DWIs with aggravating factors, such as having a juvenile in the car, can lead to jail time and lengthy revocation of the DWI convict’s driver’s license.
But criminal prosecution does not address the losses of those injured in a DWI car crash. Instead, North Carolina law permits car accident victims and their families to file a personal injury or wrongful death lawsuit to obtain compensation for their losses, such as medical expenses, property damage (the car), and pain and suffering.
Even a drinking driver who was acquitted of DWI may be sued, and his or her drinking may be a factor in such a lawsuit. Also, passengers who were riding in the alcohol-impaired driver’s car could be entitled to compensation for the injuries they suffered in the crash.
